WARRANTY

EXCEPT FOR THE LIMITED WARRANTY EXPRESSLY STATED BELOW, SUNTERRA DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. THERE ARE NO WARRANTIES WHICH EXTEND BEYOND THE DESCRIPTION ON THE FACE HEREOF.

Sunterra Outdoor 5-Year Limited Warranty

1. Limited Warranty Coverage

No product registration is required. This warranty is automatically activated upon the date of original purchase.

This warranty applies only to products purchased directly from Sunterra Outdoor or from an authorized Sunterra dealer. Purchases made through unauthorized resellers, private sales, auction platforms, or secondary markets are not covered under this warranty.

Sunterra Outdoor (“Sunterra”) warrants to the original purchaser that the firebox and primary structural components of Sunterra grills, smokers, and ovens are free from defects in materials and workmanship under normal, intended use. This warranty specifically covers structural failure or firebox burnout caused by manufacturing defects. This is a limited warranty and applies only when the product is used and maintained as intended.

Risk of loss and damage to the product passes to the purchaser when the product is delivered by the freight carrier.


2. Intended Use & High-Heat Disclaimer

Sunterra products are designed solely for outdoor cooking purposes. They are not designed or intended to be used as a fire pit, hearth, bonfire pit, or open-fire appliance.

Sunterra products are coated with high-heat paint rated for temperatures up to approximately 1,200°F when used properly for cooking. Exceeding normal cooking fires, maintaining excessive or continuous fires, or using the product as a heat source or fire pit may result in steel warping, paint failure, or other damage.

Any damage resulting from excessive heat, misuse, or operation outside the intended cooking purpose is not covered under warranty and is the sole responsibility of the purchaser.



3. Warranty Period

Residential Use: Sunterra provides a 5-Year Limited Warranty on the firebox and primary structural components. For purposes of this warranty, “5-Year Limited” means five (5) years from the original date of purchase. This warranty applies only to structural failure resulting from manufacturing defects under normal residential cooking use.

Commercial Use: For products used in a commercial setting (including but not limited to restaurants, catering operations, rental properties, and food service businesses), Sunterra provides a 2-Year Limited Warranty on the firebox and primary structural components only, covering structural failure resulting from manufacturing defects. This commercial warranty covers parts only; labor, removal, reinstallation, and freight costs are not covered. The commercial warranty is void if the product is not maintained in accordance with Sunterra’s commercial maintenance guidelines.

All other components are excluded from both residential and commercial warranty coverage unless expressly stated in writing.

4. Geographic Coverage


This warranty applies to products purchased and located in the United States (including its territories), Canada, and Mexico.

For warranty claims in the contiguous United States and Mexico, Sunterra will arrange and cover freight costs for approved warranty replacements where the defect is determined to be the result of a manufacturing error, subject to Section 5 below.

For warranty claims in Canada, this warranty remains valid; however, all freight and shipping costs associated with warranty replacements or repairs are the sole responsibility of the purchaser. Sunterra will not be responsible for cross-border shipping, customs, duties, import fees, or any related costs for Canadian warranty claims.



5. Warranty Remedies

If a valid warranty claim is approved, Sunterra’s sole obligation, at its discretion, is to repair or replace the defective component.

Labor, removal, reinstallation, and installation costs are not covered. Freight and shipping costs are generally the purchaser’s responsibility. In cases where a defect is determined to be the result of a manufacturing error, at Sunterra’s sole determination, freight costs may be reviewed and considered for coverage on a case-by-case basis.

If repair or replacement is not commercially practicable, Sunterra may, at its option, refund the purchase price as the sole and exclusive remedy.

In no event shall Sunterra be liable for food spoilage, property damage, personal injury, or any indirect or consequential damages.


6. Warranty Claim Process


To submit a warranty claim, the purchaser must:

  1. Contact Sunterra Outdoor in writing at sales@sunterraoutdoor.com. The claim must be submitted from the email address or phone number associated with the original purchase.
  2. Provide proof of purchase.
  3. Provide product model and a description of the issue.
  4. Submit clear photos or videos documenting the claimed defect.

Claims must be submitted within 90 days of discovering the issue. Claims not submitted within 90 days of discovery of the alleged defect may be denied.

Sunterra reserves the right to inspect the product and request additional documentation before approving any claim.



6a. Delivery Damage


If a product arrives with visible damage, the purchaser must note the damage on the Proof of Delivery (POD) or Bill of Lading at the time of delivery, before signing. Failure to note visible damage at delivery may result in the carrier denying a freight claim for that damage, and Sunterra cannot be held responsible for damage that was not documented at the point of receipt.

This requirement applies only to damage that is visible at the time of delivery. Defects that arise during normal use — including manufacturing defects that become apparent after the product has been put into service — are governed by the warranty claim process in Section 6 and are not subject to this delivery notation requirement.



7. Non-Transferability & Authorized Purchases


This warranty applies only to the original purchaser and is non-transferable.

This warranty applies only to products purchased directly from Sunterra Outdoor or from an authorized Sunterra dealer. Purchases from unauthorized resellers, private sellers, online auction platforms, or secondary markets are not covered under this warranty, regardless of the product’s age or condition.



8. What This Warranty Does Not Cover

  • Normal wear and tear.
  • Rust, corrosion, oxidation, or surface discoloration.
  • Paint finish, cosmetic changes, or appearance.
  • Damage caused by misuse, abuse, neglect, improper operation, or lack of maintenance.
  • Damage caused by excessive or continuous fires beyond cooking use.
  • Damage caused by weather, wind, storms, flooding, fire, or environmental exposure.
  • Modifications, alterations, or repairs not authorized by Sunterra.
  • Use of non-Sunterra parts or accessories.
  • Failure to follow Sunterra’s installation, assembly, and use instructions.

Resellers / dealers: Dealers, distributors, and resellers are not authorized to modify or expand this warranty, and any statements or promises made by such third parties that differ from this warranty are solely their responsibility and are not binding on Sunterra Outdoor.

Installation / assembly by third parties: This warranty does not cover, and Sunterra Outdoor shall have no responsibility for, any damage, malfunction, or defect caused in whole or in part by improper installation, assembly, modification, or repair performed by any third party or by the purchaser.

Product changes and discontinued models: Sunterra Outdoor reserves the right to change or discontinue product designs, features, finishes, components, and materials at any time without notice and without any obligation to update, retrofit, or modify previously manufactured products.


9. Limitation of Liability

To the fullest extent permitted by law, Sunterra’s entire liability, whether in contract, tort, or otherwise, shall not exceed the amount paid for the product, even if advised of the possibility of such damages.

In no event shall Sunterra be liable for food spoilage, property damage, personal injury, or any indirect, incidental, special, or consequential damages arising from the purchase or use of the product.



10. Governing Law


This warranty shall be governed by and interpreted in accordance with the laws of the State of Texas.

TERMS & CONDITIONS OF SALE

1. Order Placement & Payment


An order is not considered placed until payment is made in full.

All Sunterra products are custom-manufactured to order unless otherwise stated.



2. Lead Times


Standard models: 5 to 7 weeks.

Stainless steel models: 10 to 12 weeks.

Lead times are estimates and begin after full payment is received.



3. Order Finality & Cancellations


All orders are considered final once placed.

Cancellation requests are evaluated on a case-by-case basis and may be denied at Sunterra’s sole discretion.

If Sunterra approves a cancellation, the following refund structure applies:

  • Before production begins: 100% refund,
  • After production has begun or materials have been ordered: 30% retained,
  • Once fabrication is substantially completed: 50% retained,


Retained amounts reflect costs incurred for materials, labor, and production.



4. Shipping & Freight


Shipping charges are estimates and may change based on the freight carrier’s final rates.

Additional carrier-imposed charges will be invoiced to the purchaser.

All shipments are handled by third-party freight carriers. Sunterra coordinates shipping but does not control transit or delivery.



5. Delivery Inspection & Damage


The purchaser must inspect the shipment at delivery.

If visible damage is present, the purchaser must either refuse delivery or accept delivery only if damage is clearly noted on the Bill of Lading with photos.

Shipping damage must be reported to Sunterra within 48 hours of delivery.



6. Replacement Parts


Replacement parts are available for purchase at any time, subject to availability.

Photos and product details may be required to confirm compatibility.



7. Limitation of Liability


To the fullest extent permitted by Texas law, Sunterra Outdoor shall not be liable for incidental, indirect, special, or consequential damages arising from the purchase or use of the product.



8. Governing Law


These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the State of Texas.

These Warranty and Terms & Conditions constitute the entire agreement between Sunterra and the purchaser regarding the product, and supersede all prior or contemporaneous representations, whether oral or written. No modification is binding unless in a writing signed by Sunterra.
